Negotiations with the regime. Part three. January 25th, 2014

On January 25th, 2014, the third round on negotiations of the oppositional leaders with Yanukovych took place.

Here are the results, as told by first deputy head of presidential administration Andriy Portnov:

Yanukovych agreed to the demands of the opposition. Nothing on Azarov’s resignation. President Viktor Yanukovych agreed to indemnify all protest participants. General Prosecutor of Ukraine and the Interior Ministry have already proposed this to the courts. This was reported by the first deputy head of presidential administration Andriy Portnov after negotiations of opposition leaders with Viktor Yanukovych and the Working Group to resolve the political crisis.

“As a result of negotiations the parties decided:
First, on a proposal from the opposition leaders to release detainees Yanukovych has suggested the General Prosecutor to propose the courts to change the preventive measures to be other than pre-trial detention. Attorney General and Minister of Interior has made their statements, in which offered to do the same,”- said Portnov.

“In this regard, the opposition leaders should promptly provide a full withdrawal of people from Hrushevskogo street and terminate of any illegal actions,” – said Deputy Head of the Presidential Administration.

“The next proposal of the opposition was to the enactment of the amnesty law, which would indemnify all protest participants during the entire period of political crisis. Yanukovych agreed to this proposal. This solution could be supported most of the fractions if all the oссupied premises in every part of our countries would be cleared, including Independence Square”- said Portnov.

It was also agreed that the negotiating parties could mutually create a “group to agree on a political decision to return the Ukrainian Constitution of 2004, and adopt the changes in parliament, or through the mechanism of the national referendum.

“Opposition leaders noted that the mechanism of national referendum, specified in the Law on the referendum is deemed to be subject to changes. Our party agreed to establish a working group as to how to change the law on referendums and possibly suggest changes to the Ukrainian Constitution through this mechanism,”- explained Portnov.

“The parties discussed possible changes to laws passed on January 16, 2014. We… are ready to make changes to these laws and will work together with our political opponents to achieve a compromise on these laws and amendments to the laws on which we find political consensus”.

The parties also agreed to form the Central Election Commission proportionally to the size of the parliamentary factions in parliament.

“The parties have also agreed that the squares and streets of Kyiv will be gradually cleared of protestors as well as and police officers,” – concluded Portnov.

As part of the negotiations, some good job offers were made to the oppositional leaders. Yanukovych proposes Areseniuk as Prime Minister. Per Yanukovych’s website, negotiations between Ukraine’s President and opposition leaders, 25 Jan 2014, detained activists to be released, opposition leader Arseniuk offered post of Prime Minister, Vitaliy Klychko deputy premier.

Maidan before the crowd.

The opposition does not accept the conditions imposed by President Viktor Yanukovych during the negotiations on January 25th. Thus said “UDAR’s” leader Vitaliy Klitschko from Maidan’s stage.

“On our demand to cancel the “dictatorship laws” Yanukovych only proposed to amend them. Our clear position is to abolish these laws full stop. We demand to hold presidential elections this year, and we will not retreat. We will keep our positions at Maidan and in the regions. There are no extremists here! We are peaceful people, defending our rights and our demands, “- said Klitschko. “Negotiations are continuing and we will not give in to any provocations,” – added the leader of “UDAR”.

Yatsenyuk: the Opposition is ready to head the Government. Negotiations continue.
The Opposition is ready to take on the responsibility for the fate of the country and can accept President Yanukovych’s offer of positions in the Governemnt. But negotiations will continue until the authorities do not fulfill Euromaidan’s demands. Addressing the people gathered on Maidan, Yatsenyuk said:

“Yanukovych spoke to us only because you are here, on the Maidan. We are only intermediaries. Most important for us is the fate of every human life. Our first requirement, adopted by the President’s Administration, is the release of each of our comrade. Secondly, we will free all those under custody, for thousands of people have criminal cases. They must be closed, everybody has to be free, they all have to be released. The second requirement – adopting the amnesty law – is also accepted by the government. Third – the laws that have been shamefully adopted not with hands but by hooves by the shameful ruling majority on January 16th should be abolished. And we will not step back from this requirement under any conditions,”- said Yatsenyuk.

“Our fourth task are the new Ukrainian authorities. Yanukovych invited the opposition to lead the Government. What is our response? Can we take this responsibility on ourselves? We are not afraid to take responsibility for the fate of the country. We take this responsibility, but it means Ukraine’s reversal towards Europe, we are ready to lead Ukraine into the EU, a responsibility that also includes the release of Yulia Tymoshenko,” – he added.
“Another of our requirements – the position of the President of Ukraine must be neutralized. The nation should adopt a new constitution,” – said Yatsenyuk. “Tuesday, January 28, is the Day of Judgment, we do not believe any of their words. We believe only in deeds”.

Until that time, according to Yatsenuk, confrontation will continue.
To the media’s questions on whether he could become prime minister on Tuesday, Yatsenyuk answered: “That is ruled out”.

“Svoboda” leader Oleh Tyahnybok said that the opposition expects concrete action from the authorities to dismiss the Government, because he does not believe the promises of Viktor Yanukovych.
From the stage at Maidan he declared that Westerners and Ukrainian churches asked opposition leaders to continue negotiations.
Tyahnybok confirmed that the resignation of the Government was discussed on Saturday, January 25th, in the Presidential Administration.

“But do we believe them?.. And I do not believe them and never did. Because in their words they do one thing, but reality is often quite different… Every time Yanukovych offers peace the result is anassault of some kind or other trouble,”- said the leader of “Svoboda”.
“So what can we believe in? Only concrete action. Specific problem resolution only,” – said Tyahnybok.
“And so I want to invite all Ukrainians: come to Maidan everybody. Our struggle continues. Continues until we will be able to solve those issues, those demands that the present Ukrainian community makes to the President and to the bandit regime. We will continue fighting. Everybody – to Maidan,” – added Tyahnybok.

He said the opposition leaders for talks on Saturday “experienced significant progress”.

“They are speaking in a completely different manner. They are willing to have a session in parliament. They are ready to decide on the release of all political prisoners… Presently, they are not ready to talk about the laws – but we must press them here,” – said Tyahnybok. “Our position is clear: the laws of January 16th should be abolished. The question of a return to the Constitution of 2004 as well was the subject of our conversation. And then there are possibilities, including legal ones, to resolve this issue. This makes it possible to hold appropriate presidential elections not in 2015, as planned, but earlier,” – said Tyahnybok.

He said that the government began to make concessions now and Yanukovych’s mood changed dramatically after people began to attack the administrations in the regions of Ukraine.

“We have opened a second front… Regional Administrations – now in the hands of a truly people’s government… and we take full responsibility for the situation in the regions,” – said Tyahnybok. “You could say that the local People’s Radas began their work. Zakarpatya region, Lviv, Ternopil, Ivano-Frankivsk, Rivne, Volyn, Khmelnytsky, Zhytomyr, Vinnytsia, Kyiv, Sumy, Poltava region. Behold – the second front. Behold – specific actions. In Dnipropetrovsk, Kharkiv demonstrations blocking the administrations are being held. The process has started,’ – he said.
